Terms of Use

These terms are an agreement between you and Kirill Sidorets, an independent developer based in London, United Kingdom ("we", "us"), who makes and runs Setters. By using Setters you agree to them. Our Privacy Policy explains how we handle your data.

1. What Setters is

Setters lets you make AI creators, people who do not exist, and make short videos and photos in which they present your products. Setters makes this content with AI models run by other companies (listed in the Privacy Policy).

2. Who can use Setters

You must be at least 18 years old, or the age of majority where you live if that is higher. If you use Setters for a business, you confirm that you may accept these terms on its behalf, and the business is bound by them too.

3. Your account

Setters creates an anonymous account on your iPhone the first time you open it. Sign in with Apple to keep your work and credits when you reinstall or change phones: without it, deleting the app loses them. You are responsible for what happens on your account.

4. Plans and credits

Setters offers monthly plans: auto-renewing subscriptions that give a number of credits each billing period. The price and the credits of each plan are shown in the app before you buy.
You spend credits on generations. Ten credits are about one second of finished video; the app shows the price in credits before you start. Looks from the Setters library are free.
Each iPhone gets free welcome credits once, on the first account made on it, to try Setters. They are good for 8 days, and the app says so when you get them and reminds you the day before they expire; your first purchase ends them sooner, since the plan's credits replace whatever is left of them.
Credits do not carry over. Each plan includes a monthly allowance of credits for its billing period. The allowance resets at each renewal and does not roll over: whatever is left of it when the period ends, whether the plan renews or ends, does not move to the next period. A renewal starts the new period with the plan's full allowance.
If you upgrade during a period, you get the new plan's credits for that period, less the credits the period has already given you.
If a generation fails and the AI provider did not deliver a result, its credits come back to you automatically.
Credits have no cash value. They cannot be sold, transferred to another person or exchanged for money.

Payment and renewal

Payment is charged to your Apple ID when you confirm the purchase.
Your plan renews automatically each month unless you cancel it at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
You can manage or cancel your plan in your Apple ID settings (Settings, your name, Subscriptions). If you cancel, you keep your plan and its credits until the end of the period you paid for.
Refunds are handled by Apple under its policies, at reportaproblem.apple.com. If a purchase is refunded, the credits it gave are removed.
Restore Purchases in Setters brings your plan back on a new iPhone or after a reinstall.

5. Your content

Inputs are what you give Setters: product photos, names and links, descriptions and scripts. Outputs are what Setters makes: creators, looks, photos, voice tracks and videos.
You keep the rights you have in your inputs. You confirm that you have the rights to everything you upload, including product photos, logos and trademarks.
We claim no ownership of your outputs. As far as the law allows, they are yours to use, including commercially and in ads, under these terms. In some countries AI-made content cannot be protected by copyright, and similar content may be made for other users.
Ready-made creators from the library are available to every Setters user and are not exclusive to you. Creators you make are not guaranteed to be unique either.
You give us a worldwide, non-exclusive, royalty-free license to store, process and send your content only to run Setters for you (including sending it to AI providers) and to review it when needed for safety or the law. We do not use your content in our marketing without your permission.

6. What you may not create

You may not use Setters to create, upload or share content that:

shows, imitates or clones a real person, including a public figure, or their voice, without their permission, or is meant to deceive people about what someone said or did. From photo takes only a photo of yourself or of someone who agreed to it;
shows or sexualizes minors in any way, or contains sexual content or nudity;
is hateful, harassing, violent or threatening, or encourages self-harm;
promotes illegal goods or services, or makes false or misleading claims about a product, including health, medical and financial claims;
sells or promotes weapons, or campaigns for or against a candidate, party, government or political cause;
infringes someone else's intellectual property, privacy or other rights, or uses a brand you are not allowed to use;
impersonates a person or brand, or is spam, a scam or fraud.

You also may not try to get around credits, limits or safety filters, reverse engineer Setters, reach it by automated means or disrupt it.

7. Publishing AI content

Setters creators are not real people. When you publish videos made with Setters, you are responsible for following the law and the rules of the platforms where you publish them, including:

labeling the content as AI-generated where the platform or the law requires it;
marking paid promotions and ads (for example with #ad) where required;
never presenting a Setters creator as a real customer, a real review or a real testimonial.

8. Safety and reports

We may filter inputs and outputs, refuse a generation, remove content, and suspend or close accounts that break these terms. To report harmful content, use Report in a video's or a photo's menu; to report misuse of Setters, write to sidoretsk@gmail.com. We review reports promptly.

9. AI output

AI output can be inaccurate, unexpected or imperfect: faces, hands, text and speech may come out wrong. Review everything before you publish it. We do not endorse the content you make.

10. Changes to Setters

We keep improving Setters, so features, AI models and prices may change, and a model may be replaced by another. If we ever close Setters, we will tell you in the app in advance.

11. Ending

You can stop using Setters at any time and delete your account in Settings, About, Delete Account. Deleting your account removes your content and remaining credits, and does not cancel your App Store subscription: cancel it in your Apple ID settings. We may suspend or close your account if you seriously or repeatedly break these terms.

12. Liability

Setters is provided "as is". As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, sales or reputation, or for what you publish with Setters. Our total liability to you is limited to what you paid us for Setters in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

If someone makes a claim against us because of content you made or published with Setters, or because you broke these terms, you are responsible for it, as far as the law allows.

13. Apple

These terms are between you and us, not Apple. Apple is not responsible for Setters or its content, and has no obligation to provide maintenance or support for it. Apple's Standard End User License Agreement also applies to your use of Setters; where it conflicts with these terms, these terms apply as far as Apple allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Law

These terms are governed by the laws of England and Wales, and disputes go to the courts of England and Wales. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.

15. Changes to these terms

If these terms change, we will update the date at the top. For important changes we will tell you in the app before they apply. If you keep using Setters after that, the new terms apply.
